Terms and conditions

1. Scope

These terms apply to consumers (§ 13 BGB) and businesses (§ 14 BGB). Where a rule only applies to one of the two, this is stated. Deviating terms of customers only apply if we agree to them in writing.

Training not booked through the app (e.g. in-house training based on an individual quote) is governed by the terms agreed in each case.

2. What the app offers

The app is free. You can use it to view and book training dates, show the operator cards you obtained from us digitally, add licences from other providers, complete the knowledge part of the annual safety briefing, download records as PDF and receive deadline reminders.

The app is currently available in German. We may develop, change or discontinue individual features where this is reasonable for you. Services already booked and paid for are not affected.

3. Account

You need an account for bookings, cards and briefings. It is personal and not transferable. Your details must be true, in particular name, date of birth and passport photo, as they appear on your card. Once saved, we change these details when you tell us.

Keep your sign-in details secret. Bookings and briefings may only be made for the person named on the account.

If these terms are breached, in particular through false details or misuse of the card and verification function, we may block the account. We will tell you. Services already paid for and not used are refunded in that case.

4. Booking a course

The dates shown in the app are not yet a binding offer. You make a binding offer by filling in the participant details in the booking flow, choosing a payment method and tapping the button to pay, reserve or unlock. Before that you can review and correct all details.

The contract is concluded as soon as we confirm the booking, usually immediately in the app and additionally by email. The confirmation contains the essential details of the booking.

Each seat is for one person. If a date is fully booked, you can join the waiting list free of charge. If a seat becomes free, we offer it in order; the offer is valid for 24 hours. The waiting list does not create a right to a seat.

5. Prices and payment

The prices shown in the app at the time of booking apply. They include statutory VAT.

• Bank transfer: you receive our bank details and a payment reference. Your seat is reserved until the money has arrived. Payment must reach us by the start of the course at the latest.
• Company invoice (for businesses): we invoice the company you specify. The invoice is payable within 14 days without deduction. The seat is firmly reserved from the time of booking.
• Company code: if your employer bought a contingent, you enter the code when booking and the seat costs you nothing. A code is valid for one person, only for the course it was issued for, and only once.
• Pay now: if offered, you pay through our payment provider Stripe using the methods shown there. Your seat is confirmed once the payment has arrived.

We issue invoices electronically and send them by email.

6. Cancellation by you

You can cancel a booked course free of charge at any time in the app (Profile → Meine Buchungen → "Stornieren"). We refund any amount already paid in full: Stripe payments automatically to the payment method used, bank transfers within 14 days to the account they came from. A redeemed company code is released and returns to your employer’s contingent.

Your statutory right of withdrawal as a consumer remains unaffected (section 11).

7. Changes or cancellation by us

If we have to move a date, for example because a trainer is ill, equipment fails or there are too few participants, we inform you by email and push notification. You decide in the app: accept the new date or get your money back in full.

If we cancel a date altogether, we refund amounts already paid in full. Further claims, such as for travel or lost time, exist only under section 10.

8. Participation, exam and card

You must meet the legal and statutory accident insurance requirements for the course, in particular the minimum age and physical fitness for the equipment. During practical exercises you follow the trainers’ instructions. Anyone endangering themselves or others may be excluded from the exercise; there is no refund in that case.

We issue the card once you have passed the exam. It then appears in your profile and can be verified by QR code. If you do not pass, no card is issued; we will discuss a retake with you.

The digital card documents the qualification obtained from us. Only your employer can authorise you to operate equipment.

9. Annual safety briefing in the app

The briefing in the app consists of a video and a quiz of 20 randomly drawn questions to be answered within 15 minutes. You pass with 80 % correct answers and can retake it as often as you like. If the module is paid, one payment covers one passed attempt; failed attempts do not use it up.

The app provides the general knowledge part of the annual briefing (§ 12 ArbSchG, § 4 DGUV Regulation 1). The briefing on the specific hazards at the workplace, routes, operating instructions and the actual equipment remains the employer’s responsibility and is not replaced by the app.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act.

For slight negligence we are only liable if we breach an obligation whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely (cardinal obligation). In that case liability is limited to the foreseeable damage typical for the contract.

The app is built so that card and briefing are available without signal. We cannot, however, promise constant, uninterrupted availability of app and server, for example during maintenance or disruptions beyond our control.

You are responsible for the accuracy of licences from other providers that you add yourself. We mark such cards as "External".

13. Changes to these terms

Bookings already made are governed by the terms in force at the time of booking. If we change the terms for using the app, we will tell you at least four weeks in advance. You can object to the change and delete your account at any time.

14. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country of your habitual residence remain unaffected.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Cologne.

We do not take part in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so.

Should any provision be invalid, the rest of the contract remains valid; the statutory provisions apply instead.
